Please read these terms of service (referred to below as "terms" and "terms of service") carefully before using the Curious Carvings website (the "website") operated by The Parochial Church Council of the Ecclesiastical Parish of St Mary, Beverley, ("us", 'we", "our") and delivered by Heritage360, University of York.

1. The Website

curiouscarvings.org is a website site owned and operated by The Parochial Church Council of the Ecclesiastical Parish of St Mary, Beverley, who can be contacted at the email address learning@stmarysbeverley.org. By accessing and using the website you agree to be bound by the terms detailed below.

2. Use of Content

All text, data, charts, tables, software, video, music, sound, graphics, photographs, illustrations, artwork, names, logos, trademarks, service marks and other material on the website (the “Content”) may be retrieved and displayed from the website on a computer screen, printed as individual pages on paper and stored in electronic form on disk for your personal use. Press releases and digital images may be copied by our team members and the broadcast media and press. Permission should be sought from other users by contacting us at learning@stmarysbeverley.org.

The contents of this website have been made available for non-commercial reuse under the Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0).  For more information, see our Copyright page.

3. Unlawful Use

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the website by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is defamatory, or which may harass, cause distress or inconvenience to any person and the transmission of obscene or offensive content or the disruption of normal flow of dialogue within the website.

4. We are not responsible for viruses and you must not introduce them

4.1 We do not guarantee that our site will be secure or free from bugs or viruses.

4.2 You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

4.3 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

5. Rules about linking to our site

5.1 You may link to pages on our website, provided you do so in a way that is fair and legal and does not damage our reputation.

5.2 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

5.3 You must not establish a link to our site in any website that is not owned by you.

5.4 Our site must not be displayed or framed within any other website.

5.5 We reserve the right to withdraw linking permission without notice.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

7.1 All copyright, trade marks, database rights and other intellectual property rights that may exist within the content of this website shall at all times remain our property (unless where stated or released under Creative Commons licensing).

7.2 The trademarks, service marks and logos used and displayed on this website (“trademarks”) are registered or unregistered trademarks. Nothing on this website should be construed as granting, by implication or otherwise, any licence or right to use any trademark without written permission.

8. Liability

8.1 The website and content is provided “as is” and on an “as available” basis and the project team does not guarantee the accuracy, timeliness, completeness, performance or fitness for a particular purpose of the website or any content. All implied warranties, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy are excluded from these terms to the extent that they may be excluded as a matter of law.

8.2 In no event will the project team be liable for any loss including, without limitation, indirect or consequential loss, or any damages arising from loss of use, data or profits, whether in contract, tort or otherwise, arising out of or in connection with the use of the website.

8.3 The project team has tried to ensure that all the content provided on the website is correct at the time of publication. The content is provided on an information basis only and should not be relied upon. No responsibility is accepted by or on behalf of the project team for any errors, omissions, or misleading content on the website or on any other websites to which this website connects.

8.4 The project team does not warrant that the website or content will be uninterrupted or error free, that any defects will be corrected, or that this website or the server that makes it available are free of viruses or bugs.

9. Privacy

Please read our privacy policy which details the forms of information, if any, we may collect from you when you visit the website.  It also details how this information may be stored and used in accordance with the UK Data Protection Act 2018 (DPA) and European General Data Protection Regulation (GDPR).

10. Changes to the terms

The project team reserves the right, at its discretion, to make changes to any parts of the website or these terms. When these terms are amended, the project team will publish details of the amendments on the website. Your continued use of the website is taken as your agreement to be bound by these terms as amended.

11. Jurisdiction

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If these terms or any part of them should be determined to be illegal, invalid or otherwise unenforceable under the laws of any state or country in which these terms are intended to be effective, then to the extent that they are so illegal, invalid or unenforceable, they shall in that state or country be treated as severed and deleted from these terms and the remaining terms shall survive and remain in full force and effect and continue to be binding and enforceable in that state or country.

13. Conflict

If there is any conflict between these terms and any other written agreement between you and us then the latter shall prevail.

14. Events beyond our control

The project team will not be responsible for any breach of these terms caused by circumstances beyond its reasonable control.

15. Links and third-party sites

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

Third party websites that you can link through to from our website are not covered by our privacy policy.  We have no control over their contents or resources and accept no responsibility or liability for these sites.

16. File Downloads

Certain files of content are available for download from the website. These files of content are also subject to the terms above.

17. Email

The project team complies with the Privacy and Electronic Communications Regulations 2003 in the United Kingdom.

We respect the privacy of personal email addresses and email content sent to any curiouscarving.org email address. We store your email address as securely as any other personal information we hold. We will not send you unwanted email messages or junk mail and your details will not be passed to any third-party organisation without your explicit permission.

If you have given us permission, we may use email to send you messages to keep you up to date with news about ourselves, as well as anything you express an interest in, either online or through other contact.
